Please call Senator Feinstein now about the USA PATRIOT Act.
We understand that Senator Feinstein intends to speak out IN FAVOR of the
USA PATRIOT Act at a hearing in the Judiciary Committee on Wednesday.
She, apparently, does not think there are any problems caused by it and
considers that changing it would risk losing the 1st Amendment protections
it does have.
Talking (Back) Points
o The Justice Department has said that Section 215 (the business records
provision) has never been used.
If the FBI has not used it in the 2 years since September 11, they should
have no objection to bills that would make limited and reasonable changes to
it.
The Attorney General did not disclose whether other provisions of PATRIOT,
i.e., Section 505 -- "National Security Letters" -- have been used to get
electronic records from libraries. And the FBI has said they are much more
likely to use these because they don't have to go to a judge to get them.
o Changing the PATRIOT Act risks the 1st Amendment protections it does
provide.
The Act does say that the FBI cannot get Sec. 215 orders _solely_ on the
basis of the 1st Amendment activities of "US persons" (citizens and resident
aliens). However, because the agent is NOT required to even name an
individual or to say why they want the records -- other than that they are
sought in relation to a counter-terrorism investingation
-- the 1st Amendment activities of _everyone_ whose records may be swept up
in one of these seizures can come under scrutiny and, thus, their 1st
Amendment rights be violated.
